📄 Terms of Service

These Terms of Service govern your use of Datacrates, LLC’s (“Datacrates”, “we”, “us”, or “our”) services. By using our services or accessing our website, you agree to these terms.

1. Services

We provide managed IT solutions, including:

  • Network & infrastructure support

  • Cybersecurity services

  • Hardware/software management

  • Remote monitoring

  • Client dashboard access

Specific terms are outlined in client contracts or SLAs.

2. Client Responsibilities

You agree to:

  • Provide accurate information

  • Keep credentials secure

  • Report security incidents promptly

  • Cooperate with support and maintenance efforts

  • Use our services legally and ethically

3. Acceptable Use

You must not:

  • Use our services for unlawful purposes

  • Disrupt service performance

  • Breach intellectual property rights

  • Attempt unauthorized access

Violation may result in suspension or termination.

4. Billing & Payment

  • Payment terms are specified in your agreement

  • Late payments may result in service disruption

  • Fees are non-refundable unless otherwise stated

5. Availability

We strive for high uptime but allow for necessary maintenance. We are not liable for disruptions beyond our control.

6. Intellectual Property

All tools, code, and materials provided by Datacrates remain our property unless otherwise agreed. Clients retain ownership of their data.

7. Confidentiality

All business, technical, and client data shared during service delivery is treated as confidential.

8. Limitation of Liability

We are not liable for:

  • Indirect or consequential damages

  • Data loss unless due to gross negligence

  • Downtime beyond our control

Liability is capped at the value of 3 months of paid service.

9. Termination

You or Datacrates may terminate service per contract terms. Upon termination, data will be returned or securely deleted.

10. Governing Law

These terms are governed by the laws of the State of Wisconsin. Legal disputes will be handled in Waukesha County, Wisconsin.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our services indicates your acceptance of the updated terms.
